General Terms and Conditions (GTC)

§ 1 Scope of application

  1. These General Terms and Conditions apply to all contracts for the short-term rental of apartments between Bolstein GmbH and the respective tenant.
  2. Several tenants are jointly and severally liable for all obligations arising from the tenancy.
  3. Any differing terms and conditions of the tenant shall only apply if they have been agreed upon in writing beforehand.

§ 2 Conclusion of Contract

  1. The contract is concluded upon the tenant's request and acceptance by Bolstein GmbH. Acceptance can be made in writing, verbally, in text form (email, WhatsApp), or by actual performance of the service.
  2. Subletting or further letting, as well as the free transfer of the accommodation to third parties, is only permitted with the prior express consent of Bolstein GmbH.

§ 3 Accommodation, rent, handover, arrival and departure

  1. The accommodation is provided exclusively for lodging purposes for the agreed period against payment of the agreed rent.
  2. The amount of rent can depend on the length of stay and the number of people.
  3. Bolstein GmbH is entitled to demand the rental price in full or in part in advance.
  4. The accommodation will be available to the tenant from the agreed check-in time on the day of arrival.
  5. On the day of departure, the accommodation must be vacated no later than the agreed check-out time. A flat surcharge of up to 50% of the daily rental rate may be charged for late departures.
  6. The tenant is liable for all damages caused by him or accompanying persons.

§ 4 Use of the address

The use of the accommodation address for advertising, registration or business purposes requires the prior written consent of Bolstein GmbH.


§ 5 Withdrawal / Termination by Bolstein GmbH

  1. Bolstein GmbH is entitled to withdraw from the contract or terminate it without notice if:
  • the tenant fails to make payments that are due,
  • Force majeure makes contract fulfillment impossible,
  • false or misleading information was provided,
  • the accommodation is being used in breach of contract,
  • the reputation or security of Bolstein GmbH is jeopardized.
  1. The tenant has no right to compensation in these cases.

§ 6 Liability, items brought in, parking space

  1. Bolstein GmbH is only liable in cases of intent, gross negligence or breach of essential contractual obligations.
  2. No liability is assumed for items brought onto the premises by the tenant.
  3. The provision of a parking space does not constitute a safekeeping agreement. Liability for damage or loss is excluded.

§ 7 Place of performance, jurisdiction, choice of law

  1. The place of performance and payment is the location of the accommodation.
  2. German law applies.
  3. The place of jurisdiction is Bonn, provided the contractual partner is a merchant or not a consumer.
  4. Should any provision of these terms and conditions be invalid, the validity of the remaining provisions shall remain unaffected.

§ 8 Withdrawal / Cancellation by the Tenant

  1. Short stays (under 28 nights): Free cancellation is possible within 24 hours of booking. After this period, the full booking price is due.
  2. Long-term stays (28 nights or more): Free cancellation is possible up to 30 days before the agreed check-in date. After that, the first 30 nights are non-refundable.
  3. The decisive factor is the time of receipt of the cancellation by Bolstein GmbH.

§ 9 No-Show (No-Arrival)

  1. If the tenant does not appear for the agreed check-in without prior cancellation, this is considered a no-show.
  2. In this case, the full booking price is payable. No refund or replacement will be issued.

§ 10 Digital Communication and Delivery

  1. Contract processing and the transmission of information, access data, house rules and arrival instructions will be carried out in text form via email and/or WhatsApp.
  2. Declarations are considered received as soon as they are sent to the email address or telephone number provided by the tenant.
  3. The tenant is obliged to provide correct and reachable contact details.

§ 11 House Rules

  1. The currently valid house rules are part of the rental agreement.
  2. Violations of the house rules justify immediate termination of the tenancy.
  3. In this case, there is no entitlement to a refund.

§ 12 Liability in case of failures and force majeure

  1. No liability is accepted for temporary outages of internet, electricity, water, heating or similar services, unless these were caused intentionally or by gross negligence.
  2. Events of force majeure do not entitle the tenant to a rent reduction or compensation.

§ 13 Purpose of Use

  1. The accommodation may only be used for lodging purposes.
  2. Parties, events, celebrations or similar gatherings are not permitted.
  3. Use as a residence, registered address or business address is prohibited.
